About these terms
These Terms and Conditions cover this website and the business services offered by 9490-9637 Québec inc., operating as The Favorite Design (TFD). “You” means the person using the site or the business purchasing services through an authorized representative.
A written proposal, order confirmation, statement of work or service agreement sets out your purchased services. Its specific terms take priority over these general terms if they conflict. An inquiry, calculator scenario or discovery call does not create a purchase.
What we provide
TFD provides exclusive insurance lead delivery and full-service client acquisition support. Depending on your agreement, work may include creative strategy, educational ads, landing pages, assessments, CRM setup, campaign management and follow-up systems.
TFD provides marketing services. Insurance advice, eligibility decisions, underwriting and policy sales are handled by appropriately licensed professionals. Product and geographic availability must be confirmed before an order begins.
Orders, pricing and payment
Before work or lead delivery starts, we agree on the relevant product, market, volume, price, delivery method and scope. Your written order or agreement specifies payment dates, taxes, included services and any third-party charges.
For the monthly full-service partnership, the agreed monthly fee is charged automatically in advance at the start of each service month under a recurring-payment authorization provided by the client. The agreed amount, billing date and cancellation instructions must be provided before authorization. Recurring charges stop when cancellation takes effect under section 8. This authorization does not by itself cover new lead orders or additional work outside the agreed scope.
If a recurring payment fails, we will notify the client and allow three business days after notification to resolve the payment issue. If the payment remains outstanding after that period, TFD may pause its work until payment is received.
Prices marked as provisional or used in the calculator are estimates for planning. They are not a binding quote. Unless expressly stated otherwise, prices on this site are in USD.
Advertising spend and calling are separate from the advertised full-service partnership. Additional costs or work outside the agreed scope require agreement before they are incurred.
Lead delivery and exclusivity
Exclusive leads purchased from TFD are delivered to one purchasing agency and are not resold by TFD. Exclusivity does not mean that a prospect cannot independently contact another agency, compare insurance products or change their mind.
Your order defines targeting and routing. You are responsible for maintaining working delivery details and promptly reporting delivery issues. Availability, platform interruptions and campaign conditions may affect timing or volume; discuss any specific service commitment in your written order.
Lead quality and replacements
Submit a replacement request within seven calendar days after the lead is delivered. Include the lead reference and a description of the issue so we can assess it.
Qualifying issues include incorrect or unusable contact details, a duplicate already delivered to your agency, an inquiry outside the agreed product or geographic targeting, missing required consent documentation, or a prospect confirming they did not submit the inquiry.
Product targeting is assessed against the prospect’s recorded interest when the inquiry was submitted. A lead that matched the agreed targeting does not qualify for replacement merely because the prospect later requests or purchases a different insurance product offered by your agency. An unanswered call, a later change of mind or a failure to purchase does not automatically make a lead invalid.
Approved claims receive one comparable replacement lead at no additional charge. The remedy for an approved invalid-lead claim is replacement rather than account credit or a discretionary cash refund, subject to any rights or remedies required by law. The replacement addresses eligibility under the agreed lead requirements. It does not guarantee a response, appointment, policy sale or commission. Payment, refund, cancellation and any unused balance arrangements are specified in your written order; these terms do not remove rights required by law.
Your responsibilities
You must have the authority and any licenses required for your insurance activity and the markets you serve. Keep contact information secure, review the consent documentation and use lead data only for the permitted insurance inquiry.
Your agency is responsible for its outreach, calling and messaging practices, suppression requests, applicable contact restrictions, insurance disclosures and sales process. Do not resell lead records, contact people outside the permitted purpose or treat a verification record as unlimited permission to contact someone.
Provide accurate instructions, lawful source materials and the access or approvals needed for agreed work.
Client accounts, creative and data
Full-service partnership. Your agency retains ownership of its accounts and data throughout the engagement. Client-specific creative, campaign assets and deliverables created for your agency become yours once the related invoices are paid. You retain the delivered acquisition system, subject to third-party software licenses and ongoing provider charges.
For full-service engagements, TFD will complete offboarding within seven business days after both the engagement has ended and the related invoices have been paid. Offboarding includes delivery of any remaining client-owned files, documentation of the setup, transfer of any access TFD still manages for the client, and removal of TFD’s access.
Pay-per-lead orders. You receive the purchased exclusive lead records and accompanying documentation for the permitted insurance inquiry, subject to the prospect’s contact permissions and applicable privacy requirements. Purchasing leads does not transfer ownership of, or provide access to, TFD’s or PlanBridge’s advertising accounts, campaigns, creative, landing pages, funnels, automations or delivery infrastructure.
TFD retains its pre-existing templates, reusable tools and methods. Where these are included in a paid full-service deliverable, the client receives the usage rights needed to continue using that deliverable, subject to any disclosed third-party license terms. You retain rights to materials you supply and give us the permissions needed to perform the agreed services. Our website, brand and demonstration artwork may not be republished or sold without permission.
Monthly services and cancellation
The full-service partnership runs month to month unless you expressly agree to a different term in writing. You may cancel before your next billing date by emailing hello@thefavoritedesign.com or using the cancellation route in your agreement. Cancellation takes effect at the end of the current paid service period. No additional 30-day notice period applies.
For prepaid lead orders, you may request a pause in delivery by contacting our team. The undelivered paid balance may be used when the order resumes, within 12 months after the pause begins, unless a longer period is required by law or agreed in writing. A delivery pause does not itself create a right to a cash refund, subject to any rights required by law.
Ending services does not automatically reverse completed work, lead delivery, approved advertising spend or amounts already due. Handover and third-party subscriptions are handled according to your agreement.
Forecasts and business outcomes
Calculator forecasts depend on the assumptions you enter and may exclude overhead, taxes, renewals and other costs. Commission figures can represent first-year earnings attributable to policies generated from a month’s leads, rather than cash received that month.
Illustrations are examples. Forecasts, planning ranges and agency design awards are not guarantees of campaign results. Outcomes depend on factors including market conditions, product suitability, carrier terms and your follow-up and sales process.
Privacy and external services
Our Privacy Policy explains how we handle business-site information. Client data-processing instructions and consumer campaign notices must address the relevant data, purposes, permissions and responsibilities.
Scheduling, advertising, CRM, messaging and other external platforms operate under their own terms. Their availability and account decisions are outside TFD’s direct control. Keep account credentials confidential and use access permissions appropriate to each team member.
Acceptable use
Do not use the site or services to mislead people, infringe rights, bypass security, distribute malicious software, scrape personal data or conduct unlawful or abusive outreach. We may restrict access or pause affected work where reasonably needed to address misuse, security incidents or a material breach, subject to the service agreement and applicable law.
Questions, disagreements and applicable law
If something goes wrong, contact us with the relevant order details so we can work toward a resolution. Any agreed allocation of liability or dispute process is set out in your written service agreement. Nothing here excludes a duty or remedy that cannot lawfully be excluded.
Where no written agreement specifies otherwise, these terms are governed by the laws of Quebec and the federal laws of Canada applicable there, subject to any mandatory law that applies to you.
Changes to these terms
We may update the website terms and revise the date above. Changes do not retroactively alter an accepted order. Material changes to ongoing contracted services require the notice or agreement applicable to that contract.
